If you create an account, you are responsible for safeguarding your credentials and for activity under your account. Notify us if you believe your account was compromised.

Intellectual property

Macherre and its licensors own the Services, including software, branding, and site content (excluding user content you provide, which you retain ownership of subject to the license below). You receive a limited, non-exclusive, non-transferable license to use the Services for personal, non-commercial use unless we agree otherwise in writing.

User content

If you submit content (such as feedback, corrections, or uploads), you grant Macherre App a worldwide, royalty-free license to use, host, store, reproduce, and display that content as needed to operate and improve the Services.

Disclaimer of warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MACHERRE APP AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICES IS LIMITED TO THE GREATER OF THE AMOUNT YOU PAID US FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE CLAIM OR ONE HUNDRED US DOLLARS (US $100), IF APPLICABLE LAW ALLOWS.

Indemnity

You agree to indemnify and hold harmless Macherre and its affiliates from claims arising out of your use of the Services or violation of these terms, to the extent permitted by law.

Governing law

These terms are governed by the laws of the jurisdiction you choose with your counsel, excluding conflict-of-law rules. Courts in that jurisdiction have exclusive jurisdiction over disputes, unless mandatory consumer protections in your country say otherwise.
