Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and Lagodish Tech, a company based in Warsaw, Poland ("Lagodish Tech," "we," "us," or "our"), the operator of the Macherre brand, the Macherre mobile application (the "App"), the website at www.macherre.appand related subdomains (the "Site"), and any related products, content, or services we provide (together, the "Services").

Please read these Terms carefully. They include disclaimers of warranties, a limitation of liability, an indemnification obligation, and a clause governing disputes. By accessing or using the Services, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Services.

1. Eligibility

You may use the Services only if you can form a legally binding contract with Lagodish Tech. You must be at least 16 years old (or the higher age of consent in your jurisdiction). Users under the age of 18 may use the Services only with the involvement of a parent or legal guardian who agrees to these Terms on their behalf, and certain features (such as posting public content, reviews, or community participation) may be restricted. We do not knowingly allow users under 13 to use the Services. By using the Services you represent and warrant that you meet these requirements and that your use does not violate any applicable law or regulation.

2. Your account

Some features require an account. You agree to provide accurate and current information, keep your credentials confidential, and accept responsibility for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized use. We may suspend or terminate accounts that we reasonably believe violate these Terms or applicable law.

3. License to use the Services

Subject to these Terms, Lagodish Tech grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable license to access and use the Services for your own non-commercial use. You may not (and may not allow anyone else to):

  • copy, modify, adapt, translate, or create derivative works of the Services;
  • reverse engineer, decompile, disassemble, or attempt to derive source code or algorithms, except to the extent that applicable law expressly permits despite this limitation;
  • rent, lease, sell, sublicense, distribute, or otherwise commercially exploit the Services;
  • access or use the Services to build a competing product or service, or to train any machine-learning model;
  • use any robot, scraper, spider, crawler, or other automated means to access the Services or extract data, except for public-search-engine indexing in accordance with our robots.txt;
  • interfere with, disrupt, overload, probe, or breach the security of the Services or any related infrastructure;
  • remove, obscure, or alter any proprietary notices on the Services; or
  • use the Services in violation of any applicable law or regulation.

4. Acceptable use

You agree not to use the Services to:

  • upload or share content that is unlawful, infringing, defamatory, harassing, hateful, sexually explicit, violent, or otherwise objectionable;
  • impersonate any person or entity, or misrepresent your affiliation;
  • collect or harvest personal information about other users;
  • distribute viruses, malware, or other harmful code;
  • attempt to gain unauthorized access to any account, system, or data; or
  • engage in any activity that imposes an unreasonable load on our infrastructure.

We may, but are not obliged to, monitor, review, or remove user content at our discretion.

5. User content and license to Lagodish Tech

The Services may let you submit content, including reviews, ratings, comments, photos, skin profiles, routines, corrections, and feedback ("User Content"). You retain ownership of your User Content. By submitting User Content, you grant Lagodish Tech and its affiliates a worldwide, non-exclusive, royalty-free, fully paid-up, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works of, publicly display, publicly perform, distribute, and otherwise use that User Content as needed to operate, provide, improve, market, and develop the Services. Where you submit feedback or suggestions, you grant us a perpetual, irrevocable, royalty-free license to use them without obligation or restriction.

You represent and warrant that you own or have the necessary rights and permissions to submit your User Content and to grant the license above, and that your User Content does not violate the rights of any third party or any applicable law.

6. Intellectual property

The Services and all related software, designs, text, graphics, logos, trademarks, and other content (excluding User Content) are owned by Lagodish Tech or its licensors and are protected by intellectual-property and other laws. "Macherre", "Lagodish Tech", and our logos are trademarks or service marks of Lagodish Tech. No license or right is granted by implication, estoppel, or otherwise except as expressly set out in these Terms.

DMCA / IP complaints. If you believe content on the Services infringes your intellectual-property rights, please contact [email protected] with: (a) identification of the work claimed to be infringed; (b) the location of the allegedly infringing material on the Services; (c) your contact information; (d) a statement, made under penalty of perjury, that the information is accurate and you are authorized to act; and (e) your physical or electronic signature.

7. Subscriptions, in-app purchases, and payments

The Services may include free and paid features, including subscriptions and one-time purchases (together, "Paid Services"). Pricing and features for Paid Services are described where they are offered. By purchasing Paid Services, you authorize the applicable payment processor (Apple, Google, Stripe, or another processor) to charge your chosen payment method.

  • Auto-renewal. Subscriptions automatically renew at the end of each billing period at the then-current price unless you cancel before the renewal date. Cancel at any time through your App Store / Google Play account settings or through the relevant subscription management page; cancellation takes effect at the end of the current billing period.
  • Free trials and promotions. Free trials and promotional offers convert to paid subscriptions automatically when the trial ends unless you cancel before the trial expires. Each user is generally eligible for one free trial per product unless we state otherwise.
  • Refunds.Subscriptions purchased through Apple App Store or Google Play are subject to those stores' refund policies. For Paid Services purchased directly from us, refunds are at our discretion except where required by law (for example, mandatory consumer rights of withdrawal under EU law). Where applicable EU law gives you a 14-day right of withdrawal for digital content, you expressly consent to immediate performance of the Paid Service and acknowledge that you lose the right of withdrawal once the digital content is delivered or performance has begun.
  • Taxes. Prices are exclusive of VAT, sales, and similar taxes unless stated otherwise; we or the payment processor may add such taxes where required.
  • Price changes. We may change the price of Paid Services. Price changes for renewing subscriptions take effect at the next renewal after we give you reasonable advance notice; if you do not agree, cancel before the change takes effect.
  • Apple-specific terms. If you obtain the App through the Apple App Store, you acknowledge that these Terms are between you and Lagodish Tech only, not with Apple, and that Apple is a third-party beneficiary of these Terms with the right to enforce them. Apple is not responsible for the App or its content, maintenance, support, warranties, or any claims relating to the App.
  • Data sharing for refund handling. Where required to resolve refund requests with Apple or Google, you consent to our sharing limited usage information (such as whether and how purchased content was consumed) with the relevant store as permitted by their policies.

8. Affiliate links and third-party retailers

The Services may contain affiliate links to third-party retailers. We may earn a commission from qualifying purchases at no extra cost to you. See our Affiliate Disclosure for details. Third-party retailers, manufacturers, and service providers are independent of Lagodish Tech, and their terms, prices, availability, shipping, returns, and privacy practices apply to your purchases. Lagodish Tech is not a party to any transaction between you and a third party and is not responsible for it.

9. No medical or professional advice

The Services provide general information about cosmetic and personal-care products and ingredients for educational and informational purposes only. They are not a medical device and do not provide medical, dermatological, or professional advice, diagnosis, or treatment. Always read product labels, perform a patch test, and consult a qualified professional regarding any skin concern, allergy, pregnancy or breastfeeding consideration, medication interaction, or medical condition. Never disregard professional advice or delay seeking it because of something you read in the Services. You use the information in the Services at your own risk.

10. Third-party services

The Services may interoperate with or link to third-party services, websites, or content. Lagodish Tech does not control and is not responsible for those third parties. Your use of third-party services is at your own risk and is subject to their terms and policies.

11. Disclaimer of warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES, INCLUDING ALL CONTENT, DATA, AND MATERIALS, ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITH ALL FAULTS AND WITHOUT WARRANTY OF ANY KIND. LAGODISH TECH AND ITS AFFILIATES, LICENSORS, AND SUPPLIERS DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, COMPLETENESS, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; THAT THE SERVICES WILL MEET YOUR REQUIREMENTS; OR THAT INGREDIENT, PRODUCT, OR REVIEW INFORMATION IS ACCURATE, CURRENT, OR COMPLETE.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES; IN THAT CASE, THE EXCLUSIONS ABOVE APPLY TO THE FULLEST EXTENT PERMITTED, AND YOUR STATUTORY CONSUMER RIGHTS ARE NOT AFFECTED.

12. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL LAGODISH TECH OR ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SUPPLIERS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, BUSINESS, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF LAGODISH TECH AND ITS AFFILIATES TO YOU FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE GREATER OF (a) THE AMOUNTS YOU PAID LAGODISH TECH FOR THE SERVICES IN THE TWELVE (12) MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR (b) ONE HUNDRED U.S. DOLLARS (US $100).

Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law (such as liability for fraud, gross negligence, willful misconduct, death or personal injury caused by negligence, or your statutory consumer rights). Where mandatory law applies, our liability is limited to the minimum extent required by that law.

13. Indemnification

To the maximum extent permitted by law, you agree to indemnify, defend, and hold harmless Lagodish Tech and its affiliates, officers, directors, employees, agents, licensors, and suppliers from and against any claims, demands, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: (a) your use or misuse of the Services; (b) your User Content; (c) your violation of these Terms or any applicable law; or (d) your infringement of any rights of a third party.

14. Suspension and termination

You may stop using the Services and close your account at any time. We may suspend, restrict, or terminate your access to all or part of the Services at any time, with or without notice, including if we reasonably believe you have violated these Terms, applicable law, or platform requirements, or to protect the Services or other users. Upon termination, the licenses granted to you end and you must stop using the Services. Sections that by their nature should survive termination (including ownership, User Content license to us, disclaimers, limitation of liability, indemnification, and dispute resolution) will survive.

15. Changes to the Services and Terms

We may modify, suspend, or discontinue any part of the Services at any time, with or without notice. We may update these Terms from time to time; if a change is material we will provide reasonable notice (for example by posting an in-app notice, sending an email, or updating the "Last updated" date). Your continued use of the Services after the changes take effect means you accept the revised Terms; if you do not agree, stop using the Services.

16. Force majeure

Lagodish Tech is not liable for any delay or failure to perform caused by events beyond our reasonable control, including acts of God, war, terrorism, civil unrest, government action, pandemic, internet or telecommunications failure, power outage, or third-party service disruption.

17. Governing law and disputes

These Terms and any dispute arising out of or relating to them or the Services are governed by the laws of the Republic of Poland, without regard to its conflict-of-law rules and excluding the United Nations Convention on Contracts for the International Sale of Goods. The common courts competent for the seat of Lagodish Tech in Warsaw, Poland, have exclusive jurisdiction over any dispute, except that consumers may always rely on the mandatory consumer-protection rules of their country of residence and bring proceedings in the courts of that country where required by law.

Informal resolution. Before filing a claim against Lagodish Tech, you agree to first contact us at [email protected] and to attempt in good faith to resolve the dispute informally for at least 30 days.

EU online dispute resolution. The European Commission provides an online dispute resolution platform at ec.europa.eu/consumers/odr. We are not obligated and do not commit to participate in alternative dispute resolution proceedings before a consumer arbitration board.

18. Export controls and sanctions

You may not use or export the Services in violation of applicable export-control or sanctions laws. You represent that you are not located in, and you are not a national or resident of, any country or on any list to which export of the Services is prohibited.

19. General

  • Entire agreement. These Terms, together with the Privacy Policy and any additional terms that apply to specific features, are the entire agreement between you and Lagodish Tech regarding the Services and supersede prior agreements on the same subject.
  • Severability. If any provision is held unenforceable, the remaining provisions remain in full force and effect.
  • No waiver. Our failure to enforce any right is not a waiver of that right.
  • Assignment. You may not assign these Terms without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, or sale of assets.
  • No agency. Nothing in these Terms creates a partnership, joint venture, employment, or agency relationship.
  • Notices. We may give notice through the Services or by email to the address associated with your account. Notices to us must be sent to [email protected].
  • Language. These Terms were originally drafted in English. Translations are provided for convenience; the English version controls in case of conflict.
